The challenges of data protection: Law 18,331 of Protection of Personal Data

Abstract

This workshop will consist of an initial two-hour lecture by Dr. José Luis Mañas Piñar that will focus on analyzing the challenges of data protection in the sense of implementing a law and what that implies, focusing directly on the Law 18,331, with both theoretical and practical issues concerning the implementation of a new regulatory framework and a reference to the Adequacy of Community law.

Origin and evolution of the right to data protection.
The essence of the right to data protection.
The principles of data protection:

Information.
Consent.
Purpose.
Quality of data.
Security.
Independent control.

The rights of access, rectification, cancellation and opposition.
Data processing of specially protected data.
The processing of data by the government.
In particular, security of personal data.
The solvency files.
The security and enforcing the right to data protection.
The relationship between data protection and transparency.

Complementing this presentation, there will be a panel discussion to develop an extensive debate and open exchange of ideas and questions. The panel will consist of Dr. Piñar Mañas, Professor Carlos Delpiazzo, Director of the Department of Computer Law at the University of the Republic, and Federico Monteverde, Director of the Regulatory and Control Unit of Personal Data of AGESIC.

Dr. José Luis Piñar Mañas

Doctor en Derecho por la Universidad Complutense. Catedrático de Derecho administrativo de las Universidades de Castilla-La Mancha (excedente) y CEU-San Pablo de Madrid, de cuyas Facultades de Derecho ha sido Decano. Abogado del Ilustre Colegio de Abogados de Madrid. Ha sido Director de la Agencia Española de Protección de Datos, Vicepresidente del Grupo Europeo de Autoridades de Protección de Datos y Presidente fundador de la Red Iberoamericana de Protección de Datos. Adjunct Professor of Law de la Georgetown University (2005-2007). Premio San Raimundo de Peñafort, de la Real Academia de Jurisprudencia y Legislación (1997). Entre otras obras es autor de Las relaciones entre el Estado y las Regiones. La experiencia italiana (1986), Scientific Research in Spain. Essays on Constitutional, Administrative and Financial Problems, (coeditor con Andrea Orsi Battaglini, 1992), Derecho de Fundaciones y voluntad del Fundador (junto con Alicia Real Pérez, 2000), Legislación de Protección de Datos (2007), ¿Existe la Privacidad? (2008), Seguridad, transparencia y protección de datos: el futuro de un necesario e incierto equilibrio (2009), y, como Director, El Tercer Sector en Iberoamérica. Ha impartido numerosas conferencias en España, Europa, América y Australia. Miembro de los Consejos de Redacción de diversas revistas especializadas en Derecho público.
